Diplomová práce se věnuje problematice nezákonné nečinnosti veřejné správy a možnostem soudní ochrany před ní. V práci je prováděna charakteristika jednotlivých prostředků soudní ochrany. Autorka popisuje vazby a vztahy mezi jednotlivými prostředky soudní ochrany proti nečinnosti a dále také jejich vazby mezi některými dalšími prostředky proti nečinnosti. V první kapitole práce je stručně vymezen pojem nezákonná nečinnost veřejné správy a nejvýznamnější možnosti právní ochrany před ní. Dále je již věnována pozornost jednotlivým soudním prostředkům proti nečinnosti, zvláště prostředkům poskytovaných na úrovni správního soudnictví (žaloba proti nečinnosti a žaloba proti nezákonnému zásahu správního orgánu podle s. ř. s.), ale též i Ústavním soudem a ESLP. V souvislosti se soudní ochranou není opomenuta ani ochrana proti nečinnosti samosprávných profesních komor. V závěru pak autorka hodnotní úroveň soudní ochrany proti nečinnosti. Upozorňuje na některé problematické aspekty a formuluje návrhy de lege ferenda.The thesis deals with the issue of illegal inactivity of public administration and judicial protection against it. The work is characterizing individual judicial means. The author describes connections and relations between particular judicial means against inaction and also the links between some other means against inactivity. The first chapter presents the concept of illegal inactivity of public administration and the most important legal means against inaction. The attention is paid, in the other chapters, to the individual judicial means against inactivity, particularly to the means provided on the level of administrative justice (complaint for protection against inaction and complaint for protection against illegal intervention of the administrative body, which are both enshrined in the code of administrative justice), but also by the Constitutional Court of Czech Republic and The European Court of Human Rights. The protection against inactivity of self-governing professional chambers is also mentioned in the context of judicial protection. The level of the judicial protection against inactivity is assessed in the conclusion of the thesis. Author highlights some problematic aspect and formulates suggestions de lege ferenda.
