Tato diplomová práce se zabývá Podstatnými náležitostmi demokratického právního státu. Práce je rozdělena do 5 kapitol, včetně úvodu a závěru. Kapitola druhá a třetí jsou teoretického charakteru. Kapitola druhá vymezuje koncepce materiálního právního státu a jejich historický vývoj. Třetí kapitola se věnuje zakotvení podstatných náležitostí v Ústavě České republiky a právním principům. Čtvrtá kapitola je nejvýznamnější. Zabývá se judikaturou Ústavního soudu České republiky a přístupem Ústavního soudu k podstatným náležitostem demokratického právního státu.This diploma thesis is dealing with an issue of the essential elements of the democratic rule of law. The thesis is divided into five chapters, including introduction and conclusion. Second and third chapter are theoretical. The Second chapter defines the concepts of material rule of law and their historical development. The Third chapter deals with defining the essential elements in the Constitution of the Czech republic and the legal principles. The fourth chapter is the most important. It deals with the case law of the Constitutional court of the Czech republic and the Constitutional court´s approach to the essential elements of democratic rule of law.
