Tématem diplomové práce je "Závěť v právních úpravách v ČR." Jejím cílem je srovnání právní úpravy institutu závěti dle zákona č. 40/1964 Sb., občanský zákoník, v platném znění a právní úpravy dle zákona č 89/2012 Sb., občanský zákoník, jenž vejde v účinnost 1.1.2014. Práce je členěna do 5 kapitol. Kapitoly pojednávají o: institutu závěti obecně, formách závěti a jejich náležitostech, náhradnictví a svěřenském nástupnictví, úlevách při pořízení závěti, vedlejších doložkách a zrušení závěti. Tvůrci NOZ se při tvorbě inspirovali mnohými zahraničními úpravami (Německo, Rakousko, Polsko, Francie, Itálie atd.), proto jsou popsány podobnosti úpravy obsažené v NOZ s úpravami Rakouska a Německa.The topic of this thesis is "The will in the legal regulations of the Czech Republic." The aim of the thesis is to compare the legal regulation of the Institute of will under Act No.40/1964 Coll., the Civil Code, as amended, with the legal regulation of the Institute of will under Act No.89/2012 Coll., the Civil Code, which is coming into effect from 1st January2014. The thesis is divided into five chapters. The chapters deal with: the institute of will in general, the forms of will and their requisites, the substitution and the trust succession, the reliefs for wills, the secondary clauses in the testament and the revocation of a testament. The authors of the New Civil Code were inspired by various foreign regulations (Germany, Austria, Poland, France, Italy and so on). Therefore, the similarities of the New Civil Code to the German and Austrian regulations are described too.
