Tato práce je zaměřena na opatření obecné povahy, jakožto novou formou činnosti veřejné správy. Formu opatření obecné povahy stanoví pro některé instituty např. stavební zákon, vodní zákon, zákon o ochraně přírody a krajiny, zákon o elektronických komunikacích a další. Práce se zabývá definicí opatření obecné povahy, problematikou smíšených právních aktů, materiálním a formálním pojetí, problematikou tvorby opatření obecné povahy a možnostmi jeho přezkumu. Práce je pak zaměřena zejména na problematiku tvorby opatření obecné povahy a na prostředky, jimiž se může dotčená osoba účastnit tohoto procesu.This thesis is related to the measures of a general character, which is a new form of activity in a public administration. The form of measure of general character is determined for some legal institutes by the special statutes for example the Building Act, the Waters Act, the Nature Protection Act, the Electronic communication Act etc. The thesis deals with the definition of measure of general character, the legal matters of hybrid acts, the material and formal interpretations, the creation of measures of a general character and the eventualities of review. The thesis is aimed at the legal matters of the creation of measure of a general character and the procedural rights, which affected person has during the procedure of the creation of measures of a general character.
