Téma této diplomové práce jsem si zvolil z důvodu, že mi je blízké a také kvůli ucelenému zpracování tohoto tématu pro širší veřejnost. Každý z nás se pohybuje denně v prostředí internetu a často z něj stahuje soubory. Málokdo ale již ví, zda-li je jeho jednání v souladu s právem či nikoli. Právě na právní posouzení tohoto jednání jsem se zaměřil. Ve své práci jsem se zabýval legálností poskytování odkazů na díla, jež jsou chráněna autorským právem, jejich stahování ze serverů a prostřednictvím peer to peer programů, odpovědností poskytovatelů volného obsahu za legálnost děl u nich uložených. Práce obsahuje i ustanovení o počítačových programech a jejich právní odlišnost oproti jiným dílům. Snažil jsem se i objasnit povahu institutu volného užití díla, díky kterému lze za určitých podmínek stahovat díla z internetu. Práce obsahuje i částečné nastínění právní situace v USA ve vztahu k internetu a její srovnání s naší právní úpravou. Tato diplomová práce je určena zejména těm, kteří by rádi zjistili právní povahu zacházení s dílem na internetu, co lze činit a čeho se naopak vyvarovat.The reasons why I have chosen copyright on the Internet as the topic of my thesis concern the fact that I am interested in the field and I wanted to compile a comprehensive overview of this topic. A large number of people browse the Internet every day and may of them also download files from it. But hardly anybody knows whether he or she acts in compliance with law. In my thesis, I focused particularly on the assessment of such activities in the terms of law. I examined the lawfulness of providing other people with links to files which are subjected to copyright, and of downloading these files from servers or via peer-to-peer applications. In addition to that, I focused on the extent to which free content providers are liable for the content stored on their servers. A part this thesis is also devoted to the regulations concerning computer games and the differences between them and other products in the terms of law. Furthermore, I described the nature of the institution of free exploitation rights, which allows downloading copyrighted files from the Internet under express terms. Last but not least, I illustrated the legal situation in the USA regarding the Internet, and compared and contrasted it with the situation in the Czech Republic. This diploma thesis is intended for those who would like to know the way of dealing with copyrighted files on the Internet in the terms of law; more precisely, what you are allowed to do and what you should not do.
