Práce se zabývá trestem domácího vězení, který byl nově zařazen do české právní úpravy s účinností od 1.1.2010 a trestem obecně prospěšných prací, který s přijetím nového trestního zákoníku prošel zásadními změnami Text je rozdělen do čtyř částí, přičemž první část obsahuje úvod do problematiky ukládání trestů, vymezení alternativních trestů a jejich vzájemných vztahů, druhá část pak obsahuje exkurz do historie ukládání trestů. Další část práce je věnována domácímu vězení. Tato část obsahuje vymezení právní úpravy v České republice, přičemž u vybraných ustanovení je provedena komparace se slovenskou právní úpravou. Je zde rozebrán proces ukládání trestu jeho výkon a kontrola. V závěru této části, je uveden přehled právních úprav ve vybraných státech. Trest obecně prospěšných prací, v následující části práce, je strukturován stejně jako kapitola předchozí. Nalézají se zde jednotlivé fáze procesu, od uložení až po kontrolu trestu. Závěr pak vybírá ustanovení právní úpravy obou trestů v České republice a komparuje je s právními úpravami vybraných států a navrhuje možné změny úpravy v České republice.The work deals with the punishment of house arrest, which was newly included in Czech legislation with effect from 1.1.2010 and the punishment of community service, which with the adoption of new Criminal Code has undergone significant changes. Text is divided into four parts, the first part contains an introduction to the sentencing, alternative sentencing and definition of their mutual relations, the second part contains excursion into the history of sentencing. Another part contains the punishment of house arrest. This section contains the definition of legislation in the Czech Republic, and with there is also comparison in selected parts with the Slovak legislation. There is decommissioned sentencing process, performance and control. At the end of this section,there is an overview of legislation in selected states. The punishment of community service work in the following section, is structured like the previous chapter. It contains all stages of the process, the imposition of punishment to control. The conclusion then selects the provisions of the legislation of both sentences in the Czech Republic and compares them with the laws of the selected countries and proposes possible changes to modifications in the Czech Republic.
